Tenants not paying rent can cause significant hardship on landlords, not only financial but emotional too. We are sympathetic to your needs and appreciate that the longer you have a property with a tenant no longer paying the rent, your losses continue to rise, your mortgage payments still have to be paid or you risk losing your property.

We ask our clients to have an open mind, it’s is not always the tenant’s fault, circumstances change and unforeseeable events occur, that’s why, not only do we serve the eviction notice to the tenant, but we write to them asking them to get in touch with us to enable them to open a dialogue with us to see whether a resolution can be reached.

Two Strike Action Plan

STRIKE 1
Fixed Fee

  • We will check the terms and conditions of the tenancy agreement and prepare the appropriate notice. We also send a Pre-Action letter with section 8 notices informing the tenants that they are in breach of the terms of their tenancy and you therefore require your property back. The tenants will then have sufficient legal notice to find alternative accommodation and pay the arrears where applicable. At the end of the notice period, we will contact you to find our whether the tenants have vacated your property or not, if not, please see our Strike 2 procedure.

STRIKE 2
Fixed Fee + Court Fee

  • We will have the court involved, we will start legal action for the tenant eviction, this will include preparing your case file, witness statement, generating all of the paper work, submitting this to the court, paying the court fee and ensuring that we successfully obtain a fast tenant eviction possession order. Once we have the order, the tenant is generally ordered by a judge to vacate the property within 14 days.


Once we have the possession order, the tenant generally has 14 days in which to leave the property. If the tenant still does not leave (which is rare) we will ask you if you would like the bailiffs to evict the tenant.

EVICTION
Fixed Fee + Court Fee

  • If the tenant ignores the court’s order and refuses to leave then we instruct bailiffs to go to the property and remove them. You or someone authorised by you will need to be present at the eviction.
